1. Acceptance of Terms

By accessing or using PolyMedium's services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this service.

2. Description of Service

PolyMedium provides an AI-powered platform for transforming 2D images into 3D assets. Our services include:

AI-powered 3D asset generation from uploaded images
Automatic detection of the uploaded subject and an optional quality upgrade on a finished model
Export functionality in various 3D formats (GLB, USDZ, STL, turntable GIF)
Project organization and management
Public gallery for sharing assets

3. Account Registration

To use our services, you must create an account. You agree to:

Provide accurate, current, and complete information
Maintain the security of your password and account
Accept responsibility for all activities under your account
Notify us immediately of any unauthorized use

4. Wallet and Payments

4.1 Prepaid Wallet

PolyMedium runs on a prepaid wallet. You add funds in U.S. dollars ($10 minimum top-up) and are charged a fixed price per generation, set by the subject of your image and the quality you choose: $0.25 or $0.50 for an object or a drawing; $0.50, $1.00 or $3.00 for a character; and $0.25 for "Make it real" on a model generated from a drawing. Upgrading a finished model costs the price of the quality you select. The price is shown before you submit a job. Wallet balances do not expire while your account remains active.

4.2 New-User Starter Balance

New accounts receive a one-time starter balance of $3.00 on signup (twelve $0.25 models) before any top-up is required. The starter balance is a promotional grant and is not redeemable for cash.

4.3 Failed and Refunded Jobs

If a generation cannot complete, the wallet debit for that job is automatically refunded to your balance. You are only charged for jobs that produce a usable 3D model. Refunds are visible in the transaction history on the Wallet page.

4.4 Legacy Subscriptions

PolyMedium no longer offers new subscription plans. Existing subscribers may continue their plan or cancel at any time from their account settings; their monthly allocation is applied as wallet funds on each renewal.

5. User Content and Intellectual Property

5.1 Your Content

You retain ownership of the images you upload and the 3D assets generated from them. By uploading content, you grant us a limited license to process your images through our AI systems for the purpose of providing our services.

5.2 Generated Assets

You own the 3D assets generated through our service and may use them for personal or commercial purposes, subject to these terms and any applicable third-party rights in the source images.

5.3 Responsibility for Source Material

You are solely responsible for ensuring you have the right to use any images you upload. You may not upload images that infringe on third-party copyrights, trademarks, or other intellectual property rights.

By uploading an image, you represent and warrant that: (a) you own it or have permission to use it for this purpose; (b) if it depicts a person, you have that person's permission to create and use a 3D likeness of them, and you have the authority of a parent or guardian if that person is a child; and (c) your upload and your use of the resulting model do not infringe any copyright, trademark, right of publicity, privacy right or other right of any third party.

We do not pre-screen uploads for intellectual-property ownership and have no obligation to do so. We respond to valid copyright notices under our DMCA policy and terminate repeat infringers.

6. Public Gallery

6.1 License Grant

When you share an asset to the public gallery, you grant PolyMedium and all users of the platform a non-exclusive, royalty-free, worldwide license to:

Host, display, and distribute the asset on the PolyMedium platform
Allow other users to view, download, and use the asset for personal or commercial projects
Include the asset in platform marketing or promotional materials

6.2 Your Rights

You retain ownership of your original work and may:

Remove your assets from the gallery at any time
Continue using and distributing your assets outside of PolyMedium
Your display name will be shown as the creator

Note: Assets already downloaded by other users before removal remain licensed under the terms above.

6.3 PolyMedium's Rights

PolyMedium reserves the right to:

Remove any gallery asset at any time without notice
Remove assets upon receipt of valid complaints or takedown requests
Suspend gallery privileges for users who repeatedly violate policies

6.4 Content Requirements

Gallery submissions must:

Comply with our Acceptable Use Policy
Not infringe on copyrights, trademarks, or other intellectual property rights
Not include copyrighted characters (e.g., Nintendo, Marvel, Disney characters) without authorization
Be appropriate for all audiences

7. Copyright / DMCA Policy

PolyMedium respects the intellectual property of others and complies with the U.S. Digital Millennium Copyright Act ("DMCA"). Full takedown and counter-notice procedures, and the contact details for our Designated Copyright Agent, are available on our Copyright Policy page. To prevent automated scraping, the agent's full contact information is revealed on demand via a button at the bottom of that page.

Accounts that are the subject of repeated valid takedown notices may be suspended or terminated. Gallery users can also flag any asset directly using the "Report" button on the asset's detail page, which sends the report to our moderation team.

8. Prohibited Uses

You may not use our service to:

Generate content that is illegal, harmful, or violates others' rights
Upload copyrighted material without authorization
Attempt to circumvent wallet billing or security measures
Use automated systems to abuse the service
Resell or redistribute our service without authorization

9. Service Availability

We strive to provide reliable service but do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue any aspect of the service at any time. We are not liable for any downtime or service interruptions.

10. Disclaimer of Warranties

The service and all generated output are provided "AS IS" and "AS AVAILABLE", without warranties of any kind, whether express, implied or statutory. To the maximum extent permitted by law, we disclaim the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

3D models are produced by automated AI systems. The pipeline re-renders and reconstructs your subject rather than copying it exactly, and results vary with the input image. We do not warrant that any output will be accurate, complete, watertight, correctly scaled, suitable for 3D printing, suitable for any game engine or other platform, free of artefacts, or fit for any particular purpose. We do not warrant that output will be free of third-party rights, and we make no representation as to whether AI-generated output is protectable by copyright in any jurisdiction.

You are responsible for reviewing any output before relying on it, publishing it, or using it commercially. Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.

11. Limitation of Liability

To the maximum extent permitted by law, PolyMedium shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service, including any claim arising from generated output or from content you upload. Our total aggregate liability for all claims shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) fifty US dollars (US$50).

12. Indemnification

You agree to indemnify and hold harmless PolyMedium from any claims, damages, losses, or expenses arising from your use of the service, violation of these terms, or infringement of any third-party rights.

13. Termination

We may terminate or suspend your account at any time for violation of these terms. Upon termination, your right to use the service ceases immediately. You may also delete your account at any time through your profile settings.

14. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of significant changes via email or through the service. Continued use after changes constitutes acceptance of the new terms.

15. Governing Law

These terms shall be governed by and construed in accordance with applicable laws, without regard to conflicts of law principles.
